Are Court Records Public in Washington County?

Florida law broadly supports public access to government records. Under the Florida Public Records Law, Chapter 119 of the Florida Statutes, any record created or received by a public agency — including courts and their clerks — is generally available to the public upon request. This applies to Washington County court records across all case types.

That said, meaningful exceptions exist. Florida Rule of General Practice and Judicial Administration 2.420(c) identifies 23 categories of information that are automatically confidential, and Florida Statute 119.071 provides additional exemptions that protect certain records from public disclosure.

Washington County Criminal Court Records

Criminal cases in Washington County are divided between two courts based on offense severity. The Sheriff's Office handles records requests separately from the Clerk of Court. Contact the records division directly with specific identifying information about the incident or individual. Washington County Civil Court Records

Civil matters in Washington County are split between the Circuit Court and the County Court based on the dollar amount in controversy. The Circuit Court has original jurisdiction over civil cases exceeding $50,000, as well as foreclosures, injunctions, and other equitable matters. Child Support

The Clerk's Family Law Department is responsible for setting up child support cases, maintaining payment histories, and tracking arrears. Marriage Licenses

Washington County marriage licenses are issued by the Marriage License Department of the Clerk's office. Both applicants must appear in person at 1293 Jackson Avenue, Suite 101, Chipley, FL 32428, and present valid government-issued photo identification along with their Social Security numbers. The standard license fee is $86.00. A discounted fee of $61.00 applies when both parties complete a state-registered premarital preparation course and present a certificate of completion. Florida residents must wait three days after issuance unless the premarital course waiver applies; there is no waiting period for non-Florida residents. Licenses are valid for 60 days from issuance.

Adoption Records

Key Probate Rules and Requirements

  • Under Florida Statute 732.901, anyone who has custody of a will must deposit it with the Clerk of Court within 10 days of learning of the decedent's death. A Will on Deposit Form is available from the Clerk.
  • Under Florida Probate Rule 5.030, both personal representatives and guardians are generally required to be represented by a Florida-licensed attorney.
  • The venue for probating a will is the county where the decedent was domiciled at death, per Florida Statute 733.101.
  • A creditor filing a claim against an estate must submit a Statement of Claim in duplicate within three months of the first publication of notice. There is no fee for filing a claim.
  • A Caveat — used to ensure notification when a probate is opened for a particular decedent — carries a filing fee of $41.00.
  • A Disposition of Personal Property Without Administration — used for small estates consisting solely of cash assets where funeral expenses have been paid — requires a filing fee of $231.00 in cash, cashier's check, or money order. Supporting documents include the death certificate, a paid funeral receipt, and the most recent bank statement.
  • Certified copies of probate documents cost $1.00 per page plus $2.00 for certification.
