How to Look Up a Court Case in Volusia County?
Volusia County offers multiple methods for locating court case records, whether online, in person, or by mail.
Online Case Inquiry
The Clerk operates a free Case Inquiry system that covers Circuit Civil, County Civil, Family Law, Probate, and Criminal case records. Users can search by party name or case number. Pursuant to Supreme Court Administrative Order AOSC 16-14, the system now displays many public document images directly on the docket tab within each case. Certain documents require review by a Clerk before release for online viewing, and some case types and documents remain nonpublic.

Copies and Fees
Copies of court record documents cost $1.00 per page (up to 8½" × 14"). Certification is $2.00 per instrument. Exemplified certificates cost $7.00. Record searches performed by the Clerk’s office cost $2.00 per name, per year searched. Payments can be made by check or money order payable to the Clerk of the Court, or by credit/debit card online through MyFloridaCounty.com (with a 3.5% non-refundable service charge).
Are Court Records Public in Volusia County?
Court records in Volusia County are presumed open to public inspection under both Rule 2.420 of the Florida Rules of Judicial Administration and the Florida Public Records Act (Chapter 119, Florida Statutes). Any person may examine non-confidential case filings, orders, judgments, and recorded documents without demonstrating a particular interest in the matter.
Records that are confidential or restricted from public disclosure include:
- Arrest and search warrants (and accompanying affidavits) in the possession of a judge or clerk, until the warrant is executed or becomes incapable of execution
- Dependency cases, termination of parental rights, and adoption proceedings
- Records involving child abuse, neglect, or abandonment
- Medical test results such as HIV tests
- Social Security numbers, bank account numbers, and credit or debit card numbers
- Records sealed or expunged by court order
- Juvenile delinquency records
- Any record where confidentiality is mandated to prevent interference with judicial proceedings, protect law enforcement investigations, or safeguard the safety and privacy of an innocent person
Under Florida Rule of Judicial Administration 2.425, parties filing documents with the court bear responsibility for redacting sensitive personal information before submission. The Clerk’s office does not perform redaction on behalf of filers.
A sealed court file requires a court order to unseal before its contents can be viewed. The fee for sealing any court file or expungement of any record is $42.00, plus applicable copy and certification charges.
Online Viewing Limitations
While the Supreme Court Administrative Order authorizes online display of many public court documents, some records must be individually reviewed by Clerk staff before release. Cases and documents made confidential by statute or court order are excluded from all online viewing, regardless of a user’s registration status.
Volusia County Criminal Court Records
Criminal proceedings in Volusia County are divided between Circuit Court, which handles felony cases, and County Court, which handles misdemeanors and criminal traffic offenses. Criminal court departments operate at multiple locations, with the assignment generally based on where the offense occurred.

The Case Inquiry portal allows searches by defendant name or case number for all criminal case types. The Criminal Event Inquiry tool provides an alternate way to find upcoming hearings and proceedings by court officer, event type, or date.

Statewide Criminal History
For Florida criminal history records beyond Volusia County, the Florida Department of Law Enforcement maintains a central database. The Instant Search provides immediate, non-certified results. The Certified/Non-Certified Search produces notarized results by mail. Each search costs $24.00 plus a $1.00 card processing fee.
Sealing and Expungement
FDLE determines eligibility for sealing or expunging criminal records. Applicants must obtain a Certificate of Eligibility from FDLE, then file a Petition to Seal or Expunge, a Sworn Statement, and the appropriate proposed order (Order to Seal or Order to Expunge) with the Clerk’s office, along with the $42.00 filing fee.
Arrest and Inmate Information
The Volusia County Sheriff’s Office and the Division of Corrections maintain arrest records and inmate information. The Division of Corrections operates an Inmate Information site with public records of all persons incarcerated in Volusia County facilities.
Volusia County Civil Court Records
Civil litigation in Volusia County is divided by the amount in dispute. Circuit Civil handles cases where claimed damages exceed $50,000, while County Civil handles claims of $50,000 or less, including small claims (up to $8,000) and landlord/tenant evictions.

Searching Civil Records
The Case Inquiry system covers all civil case types. The Recording Division at the Volusia County Courthouse (Room A121, DeLand) also provides in-person access via public terminals. For copies of official records, requesters may visit the Recording Division or submit a written request to the Clerk’s mailing address.
The Clerk provides daily reports of new suits filed in Circuit and County cases and weekly foreclosure reports, available online for approximately 30 calendar days through the Search Records page.
Volusia County Family Court Records
Family law matters in Volusia County are handled by the Circuit Court’s Family Law division. The division presides over dissolution of marriage, simplified dissolution, child custody, child support, alimony, paternity, adoption, name changes, injunctions for protection, domestic violence cases, and termination of parental rights.

Dissolution of Marriage
Florida law requires at least one spouse to have been a Florida resident for a minimum of six months before filing. The Clerk’s office assists with preparing the primary forms for a Simplified Dissolution of Marriage; regular dissolutions are typically filed with attorney assistance or using Supreme Court Approved Forms available through Florida Courts Help.

Injunctions for Protection
There are no filing fees for petitions for injunction for protection. Five types are available under Florida law: Domestic Violence, Repeat Violence, Dating Violence, Sexual Violence, and Stalking Violence. The Clerk’s office assists petitioners Monday through Friday, 8:00 a.m. to 4:00 p.m. After business hours, the Domestic Abuse Hotline is available at (386) 255-2102 (Daytona Beach) or (800) 500-1119. All injunction forms are available online and may be e-filed through the Florida Courts E-Filing Portal.
The Clerk participates in the Hope Card Program, which provides individuals who hold a Final Injunction for Protection with a free wallet-sized or digital verification card. Hope Cards can be requested at the Henderson Judicial Center (125 E. Orange Ave., Room 101, Daytona Beach) or the Volusia County Courthouse (101 N. Alabama Ave., Room B223, DeLand), or through the Clerk’s online contact form.
Marriage Records
Marriage licenses are issued at the Recording Division at the Volusia County Courthouse (Room A121, DeLand; Phone: (386) 736-5911) and at the Henderson Judicial Center (Room 100, Daytona Beach; Phone: (386) 257-6013). The application fee is $86.00, reduced to $61.00 if the couple provides proof of completing a premarital preparation course. The ceremony fee is $30.00. Additional certified copies of the marriage license cost $3.00 each. Recorded marriage licenses can be searched through the Official Records Inquiry portal.
Statewide dissolution of marriage certificates are available from the Florida Bureau of Vital Statistics using the Application for Dissolution of Marriage form. The search fee is $5.00 (includes one certified copy), with additional copies at $4.00 each.
Volusia County Probate Court Records
The Probate and Guardianship division of the Clerk’s office maintains records for estates (formal, summary, and disposition of personal property), guardianships, wills, trusts, caveats, and mental health proceedings. Probate is handled by the Circuit Court.

Types of Estate Proceedings
Volusia County recognizes three types of probate proceedings. Formal Administration applies when significant assets require appointment of a personal representative; an attorney is typically required. Summary Administration is available when the estate subject to administration does not exceed $75,000 in value. Disposition of Personal Property without Administration allows release of non-exempt personal assets (no real property) to the person who paid final expenses such as funeral or medical bills from the last 60 days. The Clerk can assist with the filing of an Application for Disposition of Personal Property Without Administration.
Filing a Will
The custodian of a deceased person’s will must deposit the original document with the Clerk within 10 days of learning of the death, per Florida Statutes Section 732.901. The custodian should provide the decedent’s date of death or last four digits of the Social Security number. There is no charge to deposit a will without opening a probate estate.

Guardianship
A guardianship may be established for an incapacitated adult, a minor who has received an inheritance or personal injury settlement, or a minor living with someone other than a parent. The court appoints a guardian whose powers may be limited or plenary. Every guardian should become familiar with the powers and duties outlined in Florida Statutes Sections 744.361, 744.362, and 744.367. A Statement of Claim form is available for creditors filing caveats. Persons convicted of a felony cannot be appointed as guardians.
Searching Probate Records
Probate records can be searched online through the Case Inquiry system by selecting the appropriate case type. A monthly Probate Preliminary Report listing estates filed during the prior month is generated on the 7th of each month, though access to this report requires a subscriber account through the Request Online Viewing page. In-person viewing is available at public terminals in the Probate offices at both the DeLand courthouse and the Henderson Judicial Center. Copies of probate documents cost $1.00 per page, with certification at $2.00 per document. Because probate records contain confidential information, online availability may be limited, and some documents will only be accessible to authorized persons such as legal representatives, estate administrators, beneficiaries, and creditors.
