The Flagler County Clerk of the Circuit Court and Comptroller serves as the official custodian of court records generated by these proceedings.

Are Court Records Public in Flagler County?
Florida has among the broadest public records laws in the nation. Under the Florida Public Records Law (Chapter 119, Florida Statutes), records made or received by any public agency in the course of its official business are available for inspection and copying unless specifically exempted by the Legislature. Court records — including dockets, motions, rulings, judgments, orders, and calendars — fall within this framework.
The Clerk’s office permits online viewing of county and circuit civil, county and circuit criminal, and probate records pursuant to Florida Supreme Court Order AOSC 15-18. The office also maintains a policy requiring filers to avoid including sensitive personal information in court documents unless required by law.
Records that may be restricted or exempt include:
- Records revealing the identity of confidential law enforcement sources or informants
- Information identifying minors who are victims of crimes such as human trafficking
- Records protected by attorney-client privilege
- Personal financial data, including bank account numbers, debit or credit card numbers, and Social Security numbers
- Information identifying undercover law enforcement personnel
- Sealed or expunged records
- Certain active criminal intelligence or investigative information
Section 119.0714, Florida Statutes, provides a comprehensive list of court-record exemptions. Any person may request that the Clerk redact a Social Security number or complete financial account number from a court document image at no charge. The request must be in writing, delivered by mail, fax, electronic transmission, or in person, and must specify the case number, document title, and page number containing the information to be redacted.

Probate Filing Overview
Probate proceedings in Florida are governed by the Florida Probate Code (Chapters 731–735, Florida Statutes) and the Florida Probate Rules. Formal administration is required for estates exceeding $75,000 in non-exempt assets or when the decedent has been dead for less than two years. Summary administration may be available for smaller estates. The Clerk’s office collects filing fees and court costs at the time of filing; specific fee amounts depend on the type of petition and should be confirmed by contacting the Probate Division.
The Clerk’s office records certain probate documents — such as letters of administration, final judgments, and orders affecting real property — in the Official Records as well. These recorded documents are searchable through the Official Records portal and available for copying at the Recording Division during regular business hours.
