How to Look Up a Court Case in Brevard County?

The most efficient starting point for locating a Brevard County court case is the Brevard Electronic Court Application (BECA). This portal, authorized under Florida Supreme Court Administrative Order 2014-19, allows the general public to search court records at no charge. Here is how to use it:

The Clerk’s offices are open Monday through Friday, 8:00 a.m. to 5:00 p.m., excluding holidays. The Merritt Island and Palm Bay branch offices close daily from 11:30 a.m. to 1:30 p.m.

Are Court Records Public in Brevard County?

Florida has one of the strongest public access frameworks in the country. Under the Florida Sunshine Law (Fla. Stat. § 119.011), documents generated by public officials in the course of their duties are public records. This includes court records, which are expressly covered under Fla. Stat. § 119.0714. Members of the public may inspect and copy court files associated with civil and criminal cases without providing a reason for the request.

Despite this broad right of access, certain categories of information are exempt from public disclosure:

  • Records involving confidential informants in criminal investigations
  • Identifying information of sexual assault victims and minors
  • Juvenile court records (generally confidential under Florida law)
  • Records sealed or expunged by court order
  • Information about domestic violence survivors whose addresses are protected
  • Social security numbers, bank account numbers, and similar personal identifiers subject to redaction under Florida Rule of Judicial Administration 2.420

Case parties may petition the court to redact sensitive details or to seal files containing private information (Fla. Stat. § 119.0714(2)(a)). Sealed records are not accessible to the public, but a person may petition a court of competent jurisdiction to unseal a record by demonstrating that the need for access outweighs the interest that supported the original sealing order. Brevard County Criminal Court Records

Criminal cases in Brevard County are divided between the Circuit Court and the County Court based on the severity of the charges. The Circuit Court has original jurisdiction over felonies and certain serious criminal matters. The County Court handles misdemeanors and criminal traffic offenses.

Criminal court case information — including charges, case status, disposition, bail, incarceration status, and arresting agency — is searchable through the BECA portal. Users can search by defendant name, case number, or filing date range and filter results by criminal case type (felony, misdemeanor, or criminal traffic).

Arrest and Booking Records

The Brevard County Sheriff’s Office maintains a publicly accessible arrest and bookings log on its website. This online tool provides recent booking photographs, charges, and bond information at no charge. For copies of incident reports, case reports, or other law enforcement records, contact the Sheriff’s Office directly — these records are maintained separately from court files and are not held by the Clerk of Court.

Statewide Criminal History Checks

For a formal criminal background check extending beyond Brevard County court records, the Florida Department of Law Enforcement (FDLE) operates the Florida Criminal History Record Check system. Two options are available:

  • Instant search: Results returned immediately; costs $24.00 per subject plus a $1.00 credit card processing fee (non-refundable).
  • Certified search: Results delivered within approximately six business days; costs $24.00; suitable for official or employment-related purposes.

The FDLE does not accept mail requests for criminal history checks. All searches must be initiated through the FDLE’s online portal.

Brevard County Civil Court Records

Civil litigation in Brevard County is divided between the Circuit Court and the County Court based on the amount in controversy and subject matter.

The Circuit Court handles civil actions involving claims exceeding $50,000, real property foreclosures, and certain equity matters. How to Obtain Civil Court Records

Civil court records can be searched at no charge through the BECA portal using a party name, case number, or filing date. Online results include the docket, case status, litigant information, and links to publicly viewable documents. To obtain physical or certified copies, contact the Clerk’s office in person, by phone at (321) 637-2004, or submit a request through the NextRequest portal. Standard copy fees of $1.00 per page and $2.00 per certification apply.

Civil cases are also filed electronically through the statewide e-Filing portal. Self-represented litigants requiring procedural help with civil filings can schedule an appointment through the Clerk’s Pro Se Services page.

Brevard County Family Court Records

The Circuit Court’s Family Civil Division in Brevard County handles all domestic relations matters, including dissolution of marriage (divorce), simplified dissolution, child custody and support modifications, spousal support, paternity actions, adoption, emancipation, name changes, and injunctions for protection against domestic violence, repeat violence, and stalking.

Child support and alimony payments processed through the Clerk’s office carry handling fees: $0.25 per payment of $25.00 or less, 4% for payments between $25.01 and $131.24, and $5.25 for payments of $131.25 or more.

Accessing Family Court Records

Family court records are searchable on the BECA portal by party name or case number. Dissolution of marriage records can also be located by switching the search to “case type” and selecting “Dissolution of Marriage”, then narrowing results with a date range. Filed documents that are publicly available can be viewed online. However, records involving minors, domestic violence victims, and other protected parties are restricted under Florida law and will not appear in public search results.

The Clerk’s website provides family law forms and links to approved parent education and family stabilization course providers, which are required under Florida law for dissolution cases involving minor children.

Marriage Records

Marriage licenses in Brevard County are issued by the Clerk of Court. The standard application fee is $86.00 (includes preparation, oath, recording, and one certified copy). Couples who complete a premarital course pay $61.00 instead. Additional certified copies cost $3.00 each. The Clerk also performs wedding ceremonies for a fee of $30.00.

Recorded marriage licenses from 1981 to the present can be searched online through the Clerk’s marriage license search portal. To obtain certified copies of a marriage certificate, contact the Clerk’s office in person, by mail, or through the online copy request system.

Birth and Death Records

Only authorized persons — including the record subject, immediate family members, and legal representatives — may obtain certified copies. All requestors must present valid government-issued photo identification. Applications for birth and death certificates can be submitted in person or by mail using the applicable vital record application form. Mail requests must include a copy of a valid photo ID and a cashier’s check or money order for processing fees.

Brevard County Probate Court Records

Probate matters in Brevard County are heard by the Circuit Court. The Clerk of Court serves as custodian of all probate case files, including wills, estate inventories, petitions for administration, guardianship and conservatorship proceedings, and related orders.

Guardianship audit fees are also assessed: no charge for initial inventories up to $25,000; $85.00 for inventories exceeding $25,000. Annual financial return audit fees range from $20.00 (up to $25,000) to $250.00 (over $500,000).

Searching Probate Records

Publicly available probate records can be searched through the BECA portal by case number or party name. The Clerk’s website also provides a dedicated wills search page where users can look up wills deposited for safekeeping (from January 1987 onward) and wills lodged with the court. Per Fla. Stat. § 732.901, wills must be deposited with the clerk in the county of the decedent’s residence.

To request copies of probate documents, contact the Clerk’s office in person at any courthouse location, by phone at (321) 637-2004, or submit a request through the public records portal. The standard copy fee of $1.00 per page applies, with $2.00 for certification of each document.
